New law on compensation for damage caused by an official: legal mechanisms are being updated

The 14th plenary session of the Senate discussed and approved the law "On compensation for damage caused by an unlawful decision, action or inaction of a state body or its official." With the adoption of the law, a single and clear legal mechanism will be introduced for compensation for damage caused by state bodies or officials.

Previously, relations related to compensation for damage were regulated by more than 10 laws and by-laws, but they caused a number of problems. In particular, various difficulties arose in practice due to the lack of a clear procedure for making payments from the state budget.

According to the law, a single legal procedure for compensation for damage caused by state bodies and officials is established. If the damage is compensated by the state, funds can be recovered from the guilty person in a regress manner. This will allow for the return and full compensation of state expenses.

In this process, the Council of Ministers of the Republic of Karakalpakstan, regional and Tashkent city khokimiyats have the right to submit a claim to the state body where the guilty person works. One of the main principles of the law is human rights, legality, transparency and openness. At the same time, special territorial funds are being created to compensate for property damage, and their sources are clearly defined.
