An important announcement has been made in our country regarding new measures aimed at ensuring seismic safety and earthquake resistance in the construction sector. According to the draft Presidential Decree, from now on, state control and management will be further improved.
The document supports the proposals of the Cabinet of Ministers, the General Prosecutor’s Office, and the Ministry of Justice. According to it, the practice of granting permits for the accelerated construction of facilities – using the Fast-track method – will be completely abolished. The goal is to ensure full control over construction processes and guarantee safety.
New rules and legal foundations will be created
The Ministry of Construction and Housing and Communal Services, the Ministry of Economy and Finance, and the Ministry of Justice will jointly prepare projects for amendments to relevant laws and regulatory legal acts. These changes will cover the following areas:

Defining the exact legal status of construction regulations, national standards, and estimate-resource norms.

Establishing the legal status of master plans and introducing measures of responsibility for non-compliance.

Merging the categories of complexity and seismic hazard of facilities, forming a unified category, and approving it by government resolution.

Removing the activity of preparing procurement documents in capital construction from the list requiring a license.

Determining the validity period of the license for developing project-estimate documentation depending on the danger level of the facility.
Strengthening the licensing procedure
According to the new procedure, if license requirements are violated, the Ministry of Construction may suspend an organization’s license for up to six months. Also:

If a legal entity’s license is revoked, its founders and managers will not be able to obtain a new license for one year.

When obtaining a license, specific requirements will be set for specialists working full-time or part-time: competence certificates, a portfolio of completed works, and qualifications corresponding to the license category.
Author supervision will be strengthened
The designer’s author supervision will also become more effective. From now on, the supervising engineer must be clearly defined, and a separate contract for supervision must be drawn up. This will ensure that there is a specific responsible person at every stage of the construction process.
Officials emphasize that these measures will not only improve the quality and safety of construction but will also be an important step in protecting citizens’ lives and property from natural disasters. At the same time, the new system will set clear and fair rules for both investors and contractors.
