For which violations are penalty points calculated?
On February 20, amendments were made to the Code of Administrative Responsibility of the Republic of Uzbekistan in connection with the improvement of the road safety system. According to it, drivers with a penalty point for traffic violations exceeding 12 points will be deprived of the right to drive a vehicle for at least 6 months.

In this case, penalty points are calculated in addition to the main penalty for 14 types of traffic violations. These are the following violations:
  • Part three of Article 125 of the Road Traffic Code - driving vehicles with malfunctions in the braking system, steering or coupling device or re-equipped without the appropriate permit;
  • Article 125, part five – driving vehicles whose use is prohibited in accordance with the established procedure, as well as vehicles whose state license plates have been arbitrarily removed;
  • Article 126 – using vehicles with mirrors and (or) tinted (tinted) windows, as well as with coatings that restrict visibility;
  • Article 127, part one – sounding a horn without reason, installing sound and lighting devices on vehicles not provided for by the manufacturer, as well as their modification;
  • Article 128 – driving vehicles on pedestrian crossings, failure to comply with the requirements of road signs and other traffic rules;
  • Article 128-3 – exceeding the established speed limit by drivers of vehicles;
  • Article 128-4, part two – drivers of vehicles failing to obey a prohibitory signal of a traffic light or a prohibitory signal of a traffic controller;
  • Article 128-5 – drivers of vehicles causing an obstruction or causing an accident, crossing the side or section of the road intended for oncoming traffic;
  • Article 128-6 – drivers of vehicles violating the rules for stopping or parking;
  • Article 128-8 – violating the rules for transporting people in a vehicle (new article);
  • Article 128-9 – violating the rules for overtaking vehicles (new article);
  • Article 129 – drivers of vehicles participating in a group movement that threatens road safety or causes an accident;
  • Article 130 – violation of the rules for crossing railway crossings by vehicle drivers;
  • Article 137, part one – leaving the scene of an accident by participants in a traffic accident in violation of the established rules.

In this case, the maximum amount of penalty points calculated for each offense committed should not exceed 2 points.

Penalty points are calculated for one year from the date of the first commission of one of the established offenses. Each of these penalty points is automatically removed after one year.

The number of points to be calculated for each offense is determined by a resolution of the Cabinet of Ministers. For example, 2 points may be awarded for running a red traffic light. If the points exceed 12 points in total within 12 months, the driver will be deprived of the right to drive a vehicle as an additional punishment for the last offense. The term of deprivation of such rights in court proceedings shall not be less than 6 months.

A reasonable question may arise as to why points are not assigned for such offenses as drifting in cars, aggressive driving in a “chess” manner, and driving under the influence of alcohol. The reason for this is that, according to Article 128-10, which is being added to the Criminal Code of the Republic of Kazakhstan, the driver will be deprived of his license for a period of 1 to 2 years for the first time for such hooliganism on the road. There is no need to “accumulate” 12 points for this.

In addition, during the discussions of the law in the Senate, the issue of several people driving one car under a power of attorney, and in relation to whom the penalty points will be calculated, was raised.

According to the amendments to Article 17-1 of the Criminal Code of the Republic of Kazakhstan, when a violation of traffic rules is detected by radars, the owner of the vehicle or the person using it on the basis of civil law relations will be held liable. That is, if a close relative driving a car under a power of attorney or included in an insurance policy commits a traffic violation, penalty points will be accrued against the person driving the vehicle.

It will be clear when the penalty points system will actually come into effect after the government issues a decision.
