Musk Demands $134B From OpenAI and Microsoft

Elon Musk has filed a lawsuit seeking to recover up to $134 billion in total compensation from OpenAI and Microsoft for “damages caused.” Musk’s side (via attorney Stephen Molo) explains the demand by pointing to the entrepreneur’s role in launching OpenAI: they claim Musk provided a large share of the initial funding and played a key role in shaping the project.
According to sources, the lawsuit documents state that Musk asked to recover $65.5–$109.4 billion from OpenAI, and $13.3–$25.1 billion from Microsoft as “wrongful/unjustified gains” (wrongful gains). The case is expected to be heard in Oakland, California, starting in April with a jury.
The parties’ positions differ sharply in this dispute: OpenAI said it does not take Musk’s lawsuit seriously, calling it part of a “harassment campaign.” Microsoft reportedly did not comment at the time of publication in some reports.
As a reminder, Musk left OpenAI in 2018, and is now developing a competing venture called xAI. The debate around this case isn’t limited to court filings—it’s reigniting a major question across the tech world: “Who does AI serve—mission or business?”
