A new draft regulation has been developed in Uzbekistan regarding the procedure for notarizing marriage contracts. This initiative aims to fundamentally transform the process of formalizing agreements by utilizing modern information technologies and enhancing convenience for citizens.
Innovative methods for formalizing contracts
The draft regulation outlines several methods for concluding a marriage contract, catering to the preferences and opportunities of citizens:
- Traditional method: At the notary office.
- Remote method: Via video conferencing.
- On-site method: Outside the notary office, according to the client’s request.
Key requirements:
1. When formalizing contracts via video conferencing, the process must be automatically recorded in both audio and video formats by the "Notarius" automated information system.
2. During on-site formalization and signing, the process must be mandatorily recorded in audio and video by the notary. The video recording should document all participants, explanations of the document’s content, and the entire signing process.
Identity confirmation and security
The draft regulation introduces a new level of security and identity verification:
- Identification: The notary verifies the identities of the parties using modern information technologies.
- Verification: Checks are conducted using biometric data (fingerprint and Face-ID) or electronic records.
- Signing phase: During contract signing, specific devices are used to scan at least two fingerprints from each party.
Language and translation procedures
Notarial acts are conducted in the state language, but upon the request of the citizens, the text can also be provided in Russian or another acceptable language, if feasible.
If the contract is drafted in a language not understood by one or more parties, an oral translation may be provided by the notary or a translator proposed by the parties. Information about the translator is included in the document, and the translator is warned about liability in the event of incorrect or false translation.
Submission and legal ramifications
The draft regulation emphasizes the following important aspects when concluding a marriage contract:
- The contract can only be concluded between individuals of legal marital age, and it cannot be executed through a representative.
- If the parties are not officially registered as married, the contract will not have legal implications.
The submission process is also simplified: citizens can directly visit the notary office or register electronically through the Unified Interactive State Services Portal or E-notarius.uz. Notaries are required to review and accept electronically submitted applications within one business day.
The regulation also details modern procedures such as amendments and termination of contracts, grounds for denying notarial actions, automated fee calculations, and sending confirmation codes via SMS.
