Mayor Reprimanded a Woman in Her Home: Rights Activist Points Out a Dangerous Aspect (video)

A video showing Shahrisabz District Mayor Samad Hasanov entering one of the homes and inspecting its cleanliness has sparked heated debate on social media.

The 11-minute-and-6-second footage shows the mayor criticizing the condition of the home and speaking harshly to the female homeowner in front of her child. Human rights activist Abdurahmon Tashanov stressed that the incident raises legal questions related to privacy, the inviolability of the home, and the use of official authority.

Why did the inspection of the home spark controversy?

In the circulated video, the district mayor inspects several parts of the home and discusses its cleanliness and household conditions.

During the conversation, the official assesses the woman’s lifestyle and reprimands her harshly. The fact that the conversation took place in front of her child further intensified public criticism.

The main point of the controversy is not the grounds on which the mayor entered the home, but rather the extent to which it is permissible to interfere in a citizen’s private life and whether her honor and dignity were respected during the conversation.

Tashanov: The citizen was unable to resist

Abdurahmon Tashanov, head of the «Ezgulik» Human Rights Society, described the mayor’s actions as contrary to the ethics expected of a representative of state authority.

In his view, the citizen in the situation shown in the video was unable to freely resist the official’s actions or refuse to engage in the conversation.

«It is clear from the video that the citizen was unable to resist the mayor’s actions».

Tashanov also said that the footage may have been disseminated on social media in order to demonstrate the official’s «dedication».

However, he stressed that the intention to resolve a social problem does not justify interfering in a citizen’s private life, humiliating her, or placing her in an uncomfortable situation in front of her family.

«These actions must be given a legal assessment»

The rights activist said that the incident should be examined not only as a matter of etiquette and ethics, but also from a legal standpoint.

In his view, if interference in a citizen’s personal or property rights was carried out by using official authority or one’s position, the competent authorities must assess the situation.

At the same time, whether a particular act contains elements of a crime is determined not by social media users or individual experts, but by an investigation conducted by law enforcement agencies and court proceedings.

Tashanov noted that the following issues need to be examined separately:

— the legal grounds for entering and inspecting the home;
— whether consent was given to record the citizen;
— whether permission was obtained to publicly distribute the video;
— whether the person’s honor and dignity were demeaned during the conversation;
— whether the official exceeded the scope of his official authority.

What guarantees does the Constitution provide?

Article 26 of the Constitution of Uzbekistan stipulates that human honor and dignity are inviolable and that nothing may serve as grounds for humiliating a person.

Article 31 guarantees everyone the right to privacy, personal and family secrets, and the inviolability of the home. Under this provision, no one may enter a home against the wishes of the people living there. Personal data is also protected by law.

However, it is impossible to determine conclusively from the video whether the homeowner clearly consented to the visit and the recording. These circumstances should be established during an official investigation. At the same time, in the video, the homeowner says that she does not consent to the footage being distributed and asks the inspectors not to do so.

Has the mayor’s office commented yet?

Samad Hasanov is listed as the district mayor on the official page of the Shahrisabz District administration.

At the time the article was prepared, no detailed official response from the mayor’s office regarding the video, the grounds for entering the home, or whether consent was given to record the citizen could be found in open sources.

In addition, the woman shown in the video has not issued an independent statement about the incident. Therefore, before drawing a final conclusion, the positions of both sides and a legal assessment by the competent authorities are awaited.

The controversy goes beyond a single home

The incident in Shahrisabz has once again brought to the fore an old but still relevant question: what should relations between a government official and a citizen look like?

An official may examine the living conditions of residents. However, there must be a clear boundary between providing social assistance and controlling a person’s private life, and between resolving a problem and publicly shaming a citizen.

Otherwise, communication with residents may turn not into a means of strengthening trust, but into a performance staged in front of a camera.
