New York Court Delays Aave Case Over Freezing $71 Million in Ethereum

A New York court has delayed reviewing an urgent request by the Aave protocol to unfreeze $71 million in Ethereum belonging to victims of the Kelp DAO hack. Judge Margaret M. Garnett has requested additional information from the parties before the next hearing in June. This is reported by Cointelegraph.com .
Aave representatives are concerned that if the funds are not returned quickly, it could lead to user liquidations and instability in the DeFi market. However, the law firm Gerstein Harrow LLP had filed a restraining notice with the court, stating that its clients have a claim to these assets.
Judge Garnett acknowledged the complexity of the case and asked Aave to provide a clearer justification of the potential harm to users if the funds remain frozen. The court also requested further clarification on six key issues, including the legal distinctions between hacking transactions, fraud, and theft, as well as creditor priority.
The parties must submit their additional documents by May 22. The court hearing is scheduled for June 5. Meanwhile, Kelp DAO and Aave have announced that significant steps have been taken to restore rsETH tokens, with the stolen tokens expected to be returned within the next two weeks.
