Nine jurors in California are deciding the future of the leading AI company OpenAI. The trial is reviewing Elon Musk's lawsuit against OpenAI's founders and Microsoft. Although the discussions cover disagreements from 2018 and events involving Sam Altman, the jury must answer specific and narrow questions. This is reported by Techcrunch.com reports .

Elon Musk's lawyers argue that the defendants knew well that AI technologies should serve humanity and not fall under the monopoly of any single organization. Specifically, the $10 billion investment made by Microsoft in OpenAI's commercial division in 2023 sparked Musk's objections. The plaintiff claims this deal served to enrich investors, contrary to the company's charitable mission.

In turn, OpenAI's defense noted that no restrictions were placed on Musk's charitable funds. A forensic accountant hired by the company stated that all of Musk's donations were fully spent by August 2021, which could weaken the legal basis of the lawsuit. OpenAI representatives emphasize that providing ChatGPT for free aligns with the company's core mission and that revenue from commercial activities supports the non-profit foundation.

At the end of the trial, the jury may determine OpenAI's future operating model. If Musk wins, the company's commercial structure could face significant changes. Currently, the parties are preparing for new hearings regarding the consequences of the court's decision.
