The incident, which has been at the center of widespread discussions related to the education sector in the United States, has become even more heated. A federal judge in the Massachusetts district court made a significant decision on May 21 - according to which the Donald Trump administration must fully restore the activities of the US Department of Education. This was reported by CNBC.
Reinstatement of 1.3 thousand employees - court demand
Federal judge Meng Zhong emphasized that the ministry should be able to fully fulfill the tasks assigned to it by Congress, not its illegal activities. According to the court's decision, the Trump administration will be obliged to restore more than 1,300 dismissed civil servants to their posts.
This decision was made after a lawsuit was filed against the presidential decree. Recall that on March 20, Trump signed an order to reduce the Ministry of Education and instructed Minister Linda McMahon to take measures to close the department. According to the president, this is one of the steps being taken as part of the cost-cutting program.
Teachers and human rights activists oppose
A few days after the decree was issued, teachers' unions and a number of human rights organizations in the United States filed a lawsuit. They considered the decree unconstitutional and unconstitutional. The lawsuit claims that the hastily implemented cuts will completely paralyze the ministry and, as a result, may stop providing the necessary services to the population in the field of education.
As a legal basis, the plaintiffs relied on the sections of the United States Constitution on the powers of Congress. According to them, no executive branch, including the president, has the right to independently close or change the functions of an agency created by Congress.
Political context: Trump's initial move
The closure of the Department of Education is the Trump administration's first serious attempt to completely eliminate a ministerial-level structure. Previously, Trump has also indicated his intention to close organizations such as the USAID. However, this decision met with great opposition in the education sector and was overturned by a court decision.
