
In an inter-district court in the Fergana region, a lawsuit was filed for copyright infringement of the song "Ismigul," composed by the famous composer Uktam Khakimov.
The defendant in this case was Nodirbek Igamberdiyev, known by the pseudonym Nadyr. In 2023, he rearranged the song "Ismigul" in the style of "Enigma" and distributed it on a number of international platforms. This version made it to the top ten in the iTunes rankings and was also widely distributed on Instagram. However, after the author submitted complaints about the violation, the song was removed from all platforms.
Based on the claim filed by the Public Association of Copyright and Related Rights Holders of Uzbekistan, the court decided to recover a total of 46 million 200 thousand soums from the defendant. Of these, 41.2 million soums were compensated for damages caused by copyright infringement, and 5 million soums were assessed as moral damages.
According to the court's verdict, Nodirbek Igamberdiyev is now required to completely stop using the work "Ismigul." In particular, broadcasting this song, distributing it on social networks, and showing it on television and radio channels is strictly prohibited.
It is noted that according to the legislation of Uzbekistan, authors have the right to demand compensation for damages or compensation from 20 to 1000 times the basic calculated value in case of violation of the right.
