The appeal "Is it legal to collect a fine for criticism?" caused widespread discussion on social networks. The appeal mentioned that the construction company "Golden House" had established illegal penalty terms in contracts with consumers.
According to the appeal, it was found that in the contracts concluded with the company, if the client terminates the contract on his own initiative, the developer has the right to withhold 10 percent of the paid amount as a fine. It is also worth noting that if a client complains about the activities of the construction company and appeals to the media or relevant agencies, a fine of 10 percent will be applied to them.
As a result of the study conducted by the Competition Committee, this situation was recognized as a condition that sharply restricts consumer rights.
"Such clauses contradict the requirements of Articles 4, 6, 21, and 23 of the Law of the Republic of Uzbekistan "On Protection of Consumer Rights," the committee said in a statement.
As a result, Golden House Property Group LLC was officially instructed to voluntarily eliminate the violations.
The Competition Committee also reminded all business entities - they must strictly comply with the laws on competition and consumer protection.
