Property seizure will be lifted: new powers granted to the state executor

Now there is an important innovation regarding the lifting of property restrictions: in some cases, the state executor can resolve this matter by their own decision. This procedure was strengthened by amendments made to the legislation by Law No. ZRU-1119 of March 4, 2026. It is noted that the law entered into force on the day of its official publication.

The content of the news is simple, but in practice a very "reliable life hack":

If the claimant agrees to the proposal to retain unrealized property, that is, property that has not been sold, but has already been put up for sale, the bodies carrying out state registration of property rights and other real rights (registration bodies) cancel the seizure of the property on the basis of a decision of the state executor.

In this case, the decision of the state executor serves as the basis for state registration (registration) of the same property in the name of a new person. That is, the documents will not be wasted: there is a decision - the way to formalization is open.

But there is also an important "nuance" - and it is especially important for debtors:

Existing obligations (debt, claim, encumbrance) for the property remain with the debtor, who is the former owner. Only one exception: if the claimant agrees to voluntarily assume these obligations, then it can be otherwise.

In conclusion, this law accelerates one "stopped" point in the enforcement process: the issue of unsold property will be resolved more clearly and practically. But both sides have a clear signal: read the documents correctly, determine who will retain the obligation - then you can't run away saying "I didn't know this."
