A new law has been adopted to strengthen the protection of intellectual property

An important step has been taken in our country towards the more effective and modern development of intellectual property. The recently adopted law “On amendments and additions to certain legislative acts” aims primarily to simplify the registration procedures for intellectual property objects, broaden the protection of rights holders’ interests, and ensure their legal rights.

A new article added to the Criminal Code

According to the law, criminal liability for actions related to copyright and related rights violations has been strengthened. For example, the illegal use of works or related rights objects, as well as reproduction, distribution, or public dissemination of counterfeit copies, will now result in harsher punishment. Such acts may lead to a fine of 50 to 100 BRV, or up to two years of corrective labor, or restriction of freedom, or imprisonment for up to two years.

Aggravating circumstances of violations

If such offenses are committed repeatedly, by a group of persons with prior conspiracy, using official position or mass media, and causing large-scale damage, the penalty will be even more severe. In such cases, the offender may face a fine of 100 to 150 BRV, or corrective labor from two to three years, or restriction of freedom, or imprisonment for up to three years.

New opportunities and facilities

The law also introduces several improvements and reforms:

  • reduction of the time limits for the examination of certain intellectual property objects;

  • additional facilities for the payment of patent fees;

  • strengthening liability for violations of intellectual property rights.

Amendments to laws

The adopted law also introduces changes and additions to the following:

  • “On the legal protection of computer programs and databases”;

  • “On inventions, utility models, and industrial designs.”

Experts believe that this new law will play a crucial role in ensuring a fair competitive environment in the field of intellectual property, guaranteeing the protection of authors’ and creators’ rights, and supporting the development of innovative ideas.
