
According to the press service of the Committee for the Development of Competition and Protection of Consumer Rights, a recalculation order has been issued regarding this situation. An entrepreneurial entity operating in the communications sector in Tashkent city, dissatisfied with the activities of "Hududiy elektr tarmoqlari" JSC and its "Energosavdo" branch, appealed to the Committee.
According to inspections carried out, although the metering equipment was installed by the RES company, their secondary circuits were placed incorrectly. As a result, due to a technical error, more than 1 billion 97 million soums of additional payment was collected from the consumer over the past three years.
This technical error is provided for in the new rules for the use of electric energy, but was not included in the old rules. In addition, the sub-subscriber correctly connected to this meter had their meter readings calculated without discounts.
It is reported that according to Article 18 of the Law "On Competition", collecting excessive payments above the set prices, which leads to restriction of competition or violation of the rights and legitimate interests of consumers and other business entities, is considered an abuse of a dominant market position and is prohibited. Based on the above, the special commission of the regional department initiated a case against "Hududiy elektr tarmoqlari" JSC and its "Energosavdo" branch for violating the requirements of the Law "On Competition".
As a result of the review, a decision was made to recalculate the unlawfully collected 1 billion 97 million soums from the consumer and submit the relevant documents to law enforcement agencies. This is done to prevent such violations and assess compliance with the rules for the use of electric energy.
The Committee emphasizes that parties dissatisfied with this decision and the special commission's instruction have the right to appeal to the Committee's Appeals Board or to the court.
