For the first time in U.S. history, an artificial intelligence (AI) has allowed a deceased person to “speak” in court during the sentencing of his killer. The family of Christopher Pelkey, who was shot and killed in a 2021 traffic accident in Arizona, used AI to create a video appeal on his behalf.

The initiative was led by Christopher’s sister, Stacy Wells, who created the video with her husband and a friend (both AI experts).

In the appeal, Pelkey ​​announced that he had forgiven his killer, Gabriel Horcasitas.

“Gabriel Horcasitas, who shot me, deeply regrets what he did, and perhaps in another life we ​​could have been friends. I believe in forgiveness and in a forgiving God. I always have, and I still do,” Pelkey ​​said, using AI.

Judge Todd Lang was reportedly moved by the video and sentenced Horkasitas to 10.5 years in prison for murder, more than the 9.5 years sought by the prosecution.

Arizona Supreme Court Chief Justice Ann Scott Timmer said AI has the potential to “create great efficiencies in the justice system and help those without legal training better present their cases.”

However, she said AI can also obstruct or even pervert justice if used improperly.

“The best approach is a balanced approach. In that regard, the court has established an AI committee to study the use of AI and make recommendations on how best to use it… Those who use AI, including the courts, are also responsible for the accuracy of the decisions they make,” she said.
