In the system of the Bureau of Compulsory Enforcement, cases related to the collection of alimony are always one of the most pressing topics. As a result of explanatory and preventive measures carried out by state executors, in many cases, fathers choose to donate various property or housing instead of alimony in the interests of their children.
This time, the father, who lives in the Chimbay district, preferred to give his house instead of various options. His house is located on the territory of the "Ozgara" rural citizens' assembly and is a 3-room residential building.
If we examine the situation in detail, according to the decision of the Chimbay Inter-District Civil Court, alimony was to be collected from the debtor J.B. in the amount of 1/3 of his monthly income for the maintenance of his two children. After the court document was received by the Chimbay District Department of the Bureau of Compulsory Enforcement, the enforcement proceedings began.
However, J.B. did not make the established payments on time, and his debt exceeded 45 million soums. Therefore, the executors began to take a number of measures to resolve the debt issue.
As a result, the claimant applied to the Bureau of Compulsory Enforcement on September 22 of this year. In it, the debtor J.B. announced that the house was accepted in exchange for a debt of more than 45 million soums, and for this reason, he will refuse to pay alimony to his children under the age of 18. After that, the enforcement proceedings were officially completed.
Such cases are noted as a clear example of the effectiveness of control and effective measures on alimony payments by state bodies.
