Under the law, alimony is a child’s legal right and a mandatory payment intended to support the child, ensure healthy development, and provide a decent standard of living. (Article 99 of the Family Code of the Republic of Uzbekistan)
The Chilonzor District Department of the Bureau has an enforcement document in its proceedings to collect alimony from debtor X.R. in favor of claimant M.N. in the amount of 1/6 of the debtor’s monthly income, based on the writ of execution dated 08.04.2010 issued by the Bukhara Interdistrict Civil Court.
To ensure enforcement actions, the state enforcement officer sent inquiries to relevant organizations via the “MIB-portal” electronic information system to identify the debtor’s property; an apartment registered in the debtor’s name was found and a restriction was imposed in accordance with the law.
In addition, pursuant to Article 42¹ of the Law of the Republic of Uzbekistan “On Enforcement of Judicial Acts and Acts of Other Bodies,” the debtor’s right to leave the territory of the Republic of Uzbekistan was temporarily restricted.
During enforcement actions, the alimony arrears were calculated in accordance with Articles 99 and 140 of the Family Code of the Republic of Uzbekistan and totaled 33,855.0 thousand soums.
As a result of the lawful compulsory enforcement measures taken, the alimony arrears accrued until the child reached the age of 18 were collected in full, ensuring the child’s legal interests.
