New Law to Fundamentally Reform Rental System in Uzbekistan

A new law to significantly reform the rental system in Uzbekistan is being drafted

A draft law has been developed in Uzbekistan to elevate rental relations to an entirely new level. This document aims to transform the country's rental practices into a modern, transparent, and competitive system. The new law is expected to come into force on January 1, 2027, and will fundamentally renew the current regulations.

The draft precisely defines the concept of renting, the parties involved in rental relations, and rental objects. It emphasizes key principles such as legality and transparency in property leasing, a competitive environment, trust-based relationships, and environmental safety.

One of the most notable innovations is ensuring transparency in leasing state and private property through electronic platforms. The process of leasing state property will now be conducted via authorized bodies, online electronic auctions, and the E-Ijara information system. This practice is expected to reduce corruption risks, enhance competition, and ensure the fair distribution of properties.

The draft law clearly outlines the roles of several government institutions: a specialized center under the Agency for State Asset Management, the State Tax Committee, and the Cadaster Agency will operate within their jurisdictions regarding rental relations.

Additionally, the establishment of lease agreements, their validity periods, rent payments, obligations of the parties, and procedures for modifying or terminating agreements are detailed in the document. In specific cases, the registration of real estate lease agreements with state authorities is mandatory, and unjustified rent increases are prohibited.

The new draft law also specifies rules for various areas of rental:

— leasing of land plots;

— renting out state property;

— usage of cultural heritage sites;

— leasing water resources and reservoirs;

— regulations for using the property of enterprises with state participation;

— leasing non-governmental organizations' property and common property in multi-story buildings.

In addition, the law stipulates the repeal of the "Law on Rent" adopted in 1991 and several related documents. The implementation of the new law and the dissemination of its essence to the public may be assigned to the Ministry of Justice and other concerned institutions.

With the establishment of a new legal framework for the rental system in Uzbekistan, the market is expected to achieve higher levels of order, transparency, and trust. This development will create more opportunities for both citizens and businesses.
