This tragedy occurred on May 1, 2023, but the court process was only recently concluded. The “South China Morning Post” reported this tragedy.
On the day of the tragedy, the father was in the car with his daughter and two children. The sister and mother were sitting in the second row, and the 2-year-old child was alone in a special child seat on the third row. When the older sister lowered the seat, the child’s head became severely trapped. As a result, the child lost consciousness, and the body began to turn blue.
When taken to the hospital, doctors determined that the child had already died due to a brain injury and oxygen deprivation. This incident caused great shock and grief for the parents and the local community.
The parents filed a lawsuit against the car company, demanding compensation and an apology. They claimed that the car did not have an automatic return (auto-retraction) function and that the company had not provided sufficient warnings. The family requested a payment of $280,000 — covering medical expenses, psychological support, and compensation for the child’s death.
However, the car company stated that its products meet all industrial standards, passed China’s mandatory quality tests, and are safe. Therefore, the claim was rejected. The Pudong District Court also concluded that the tragedy was caused by “parental negligence.”
Judge Xi Shaojun emphasized that the company is responsible only if the customer uses the product under normal conditions. The primary safeguard for children’s safety is responsible parental supervision. Following the court ruling, the parents’ claim was legally rejected.
This case serves as an important lesson for parents — every measure of supervision and attention is critical for children’s safety.
