The procedure for transferring ownerless real estate to state ownership is approved

A draft government resolution "On approval of the Regulation on the procedure for identifying, registering and transferring ownerless immovable property to state ownership" has been developed.
In accordance with Article 191 of the Civil Code, an ownerless property or an owner of which is unknown is considered to be ownerless property.
After one year has passed since the registration of an ownerless immovable property, the body authorized to manage state property or a citizen self-government body may apply to the court with a request to consider this property as state property or the property of a citizen self-government body.
By the Presidential Decree "On the Privatization Program for 2025", the State Assets Management Agency is granted the right to file lawsuits with the courts for the state registration of ownerless immovable property as state property from October 1, 2025.
It is established that the tasks of identifying ownerless real estate (except for housing stock), filing lawsuits with courts for state registration of ownerless real estate objects as objects of state property, and effective use of objects transferred to state ownership are carried out by the Center for Effective Use of State Property Objects under the State Assets Agency.
The Regulation on the procedure for identifying, registering and transferring ownerless real estate to state ownership is approved, which provides for the following:
- determining the procedure for identifying, registering and transferring ownerless real estate to state ownership;
- granting the bodies of the State Assets Management Agency the right to apply to the court with a request to recognize real estate as ownerless real estate and transfer it to state ownership.
The Ministry of Digital Technologies, together with the State Assets Agency, will:
- develop a special electronic information system for identifying and recording ownerless buildings and structures;
- to implement the measures provided for in this resolution, ensure the integration of this information system with other information systems through the interdepartmental integration platform of the "Electronic Government" system.
