Uzbek citizens briefed on the procedure for notarizing prenuptial agreements

The Ministry of Justice has registered a document that sets out how notaries should handle the certification of prenuptial agreements. This was reported by podrobno.uz reports .
According to the ministry, the notarization of a prenuptial agreement can be carried out at a notary office, via video conferencing, or, at the applicants’ request, off-site. To start the process, the parties apply in person to a notary office or submit an application through the Unified Portal of Interactive Public Services (EPIGU) as well as via E-notarius.uz. After that, the notary verifies the citizens’ identities.
The notary must also determine whether the parties have reached the legal marriage age, are not in another registered marriage, and whether a similar agreement has not previously been formalized between them. Once the draft agreement is fully prepared and the service fees are paid, the parties are invited at the same time to sign the document. Signatures are affixed in the presence of the notary, indicating the full surname, given name, and patronymic.
It was previously noted that notaries are not required to mandatorily request the original copy of a prenuptial agreement certified within the country. Copies of documents are uploaded to an automated information system, and audio and video recordings confirming the notarization process may also be attached to the system.
