Criminal case opened against deputy chair of Tashkent City Court and judges

During оперативные measures carried out in cooperation with several members of the Tashkent City Court and other law enforcement agencies, new information was received regarding circumstances linked to ordinary criminal cases. According to a report published on January 12, a criminal case has been opened against a number of senior judges and officials of the Tashkent City Court.

Judges and responsible officials named as defendants

A criminal case has been opened under several articles of the Criminal Code against Muradjon Mirzajonov, deputy chair of the Tashkent City Court, and former judges Odilbek Ilhomjonov, Mirziyod Abidov and Muhtarama Turgunova. They are accused of crimes such as unlawful influence and interference with the administration of justice.

Verdict and appeal

As for the case of Akmal Shukurov, it is considered a significant event involving both civil and criminal law. His criminal case covers several articles, including allegations of fraud, intentional grievous bodily harm and hooliganism. His latest verdict was issued on October 24 this year, and under the relevant articles of the Criminal Code he was sentenced to 8 years and 1 month in prison.

Violations in court proceedings

The defendant A. Shukurov disagreed with the above verdict and filed an appeal. The appeal was reviewed by appellate judges O. Ilhomjonov, M. Abidov and M. Turgunova, who concluded that the first-instance verdict should be changed and, applying Article 57 of the Criminal Code, the sentence should be replaced with 3 years’ imprisonment.

However, M. Mirzajonov, deputy chair of the Tashkent City Court, allegedly abused his official position, obstructed a comprehensive, complete and impartial review of the case, interfered in court proceedings and unlawfully influenced the judges. As a result, although the judges knew in advance that his instruction was illegal and were independent in administering justice and making decisions, they failed to follow the principle of inevitability of liability: they changed the first-instance verdict, applied Article 57 of the Criminal Code, lifted the pre-trial detention measure, ultimately replaced the punishment with 3 years and 3 months of restriction of liberty, released him from custody in the courtroom, and issued an unlawful and unjust ruling that led to serious consequences.

Based on the above, within the criminal case the former deputy chair of the city court M. Mirzajonov and former criminal court judges O. Ilhomjonov, M. Abidov and M. Turgunova have been brought into the case as defendants, and a preventive measure in the form of detention has been applied.

Initial investigative actions are currently being conducted by the Prosecutor General’s Office.
