The procedure for registering land and housing inheritance is being simplified

In recent years, reforms in the construction and cadastre sectors have been rapidly progressing, but there are still a significant number of citizens with incomplete or unregistered documentation for real estate objects. To create convenience for citizens in inheritance matters, a new draft law has been developed.

Buildings without documents also included in the inheritance

One of the biggest innovations is that, from now on, real estate objects for which the rights to land plots on which they are located have not been registered, but belong to the deceased, can be included in the inheritance. Previously, such cases often led to numerous lawsuits.

According to the new procedure, the right of ownership of the land plot passes to the new owner based on a notarized certificate and is entered in the State Register of Real Estate Objects. This reduces unnecessary bureaucratic hurdles for heirs.

Possibility of registering rights in the name of the deceased

The draft law also introduces important additions to the Law "On State Registration of Rights to Real Estate Objects":

  • Buildings with unregistered rights: At the request of the deceased's close relatives, buildings can first be registered in the name of the deceased.
  • Unfinished objects: A similar procedure is proposed for application to construction objects that have not yet been completed.

This mechanism allows heirs to directly and systematically transfer ownership from the legal owner (the deceased) to themselves.

Protection of lands acquired in private ownership

In addition, information about the owners of land plots acquired, gifted, or inherited as private property will be strictly reflected in the state register. This will further strengthen state protection of landowners' rights.

These reforms are designed to solve long-standing problems of the population, increase the transparency of the real estate market, and guarantee property rights for citizens.
