Preferential pension reinstated for Jizzakh doctor
The press service of the Human Rights Representative of the Oliy Majlis provided information regarding an appeal received from Jizzakh region. It was reported that a resident of Jizzakh region complained to the Ombudsman after being refused a preferential pension.

The citizen worked in a pathology-anatomy department under hazardous working conditions from 1998 to 2021, but was denied a preferential pension because the workplace had not been certified as hazardous. Based on the citizen's complaint, a lawsuit was filed in court.

During the trial, it was confirmed that the citizen had indeed worked under harmful conditions. Nevertheless, the responsible official again refused to assign the pension, citing that the employer had not paid insurance contributions.

The Ombudsman's office emphasized that shortcomings in the employer’s financial calculations cannot limit the employee's right to a pension. For this reason, another lawsuit was filed in court to have the relevant authority’s decision declared illegal.

As a result, the court found the decision of the Pension Fund to be illegal and ordered the assignment of the pension in favor of the citizen. Thus, the citizen’s rights were fully restored and he was able to receive his preferential pension.
