New procedure introduced for seriously ill prisoners
In Uzbekistan, important amendments are being made to legislation for prisoners who are serving sentences but are in serious health condition. Now, the procedure for conducting full inpatient medical examinations of seriously ill prisoners and their release from serving sentences due to illness will be clarified further, reports norma.uz.

Specifically, for prisoners receiving treatment in correctional institutions and diagnosed with serious illnesses, a medical conclusion from doctors alone will not be sufficient — the diagnosis must also be confirmed by the chief inspector-physician of the Medical Department of the Ministry of Internal Affairs of Uzbekistan. This is seen as a step aimed at preventing hasty and ambiguous decisions.

Prisoners with mental disorders will be thoroughly examined in inpatient conditions at psychiatric hospitals or relevant psychiatric wards. Here, they will undergo both physical and psychological evaluations. Each case will be diagnosed and assessed carefully, with the involvement of professionals.

A decision to release a sick prisoner from serving their sentence is made in a court session. The session includes the prisoner, the prosecutor, in necessary cases — the defense attorney and their legal representative, the head of the institution that submitted the proposal, a representative from the hospital (medical department), and the treating physician (in case of mental health issues — a psychiatrist).

If the court decides to release the prisoner based on illness, the decision may be appealed by the prosecutor, the prisoner, their legal representative, or defense attorney in a higher court.

These updates reflect a reassessment of penal policy based on humanitarian principles. At the same time, they demonstrate the state’s aim to ensure adequate medical assistance for people in serious condition, uphold standards of justice, and prioritize human dignity.
